Article I
The name of this organization shall be the Universal Gymnastics Booster Club.
Article II
Universal Gymnastics Booster Club has been established for the purpose of promoting, supporting, and improving gymnastics and its gymnast. The Booster Club has been created to offset the specific expenses incurred as a participant in gymnastic competitions. Thus, the Booster Club will be responsible for collecting member dues, organizing fundraisers, seeking charitable contributions to defray the expenses of competitive gymnastics. The booster club will assist in communication between parents/guardians and Universal Gymnastics. Therefore, each competitive gymnast must be part of the Universal Gymnastics Booster Club.
Article III
Universal Gymnastics Booster Club will conduct itself in a manner which is free from discrimination whether racial or any other type in order to provide equal opportunity and treatment for all members regardless of race, color, religion, sex or national origin. Hence, the booster club shall be a not-for-profit and non-partisan organization. Thus, no one individual or member shall profit from or benefit from any part of the net earnings.
Article IV
Membership is open to all persons regardless of race, sex, religion, or national origin interested in furthering the purpose of the club. Membership is $50.00 per family for one year beginning on a calendar year of January 1st. to December 31st. This fee is due by December 01 for each upcoming calendar year. Before the commencement of competitive seasons, Universal Gymnastics management along with the Booster Club will work together in order to provide a competition listing and facilitate payments from each member. There shall be three categories of membership: Regular, Elected Officials and Appointed Officers.
Regular members are parents, guardians, or individual who support the purpose of the club. Regular members shall pay dues, have the right to vote, and have the right to hold a club office.
Elected Official is those individual who are selected by vote from the parents, guardians, or individual who support Universal Gymnastics by a majority vote. Elected Officials shall pay dues and have the right to vote.
Appointed officers are those members selected for a specific function in order to reach a common goal or support the booster club. Appointed officers shall pay dues and have the right to vote.
Article V
Finances
· Each year the competitive season schedule for each competitive gymnast will be tallied and the cost will be divided among each gymnasts. Optional gymnast cost will be split among optional levels only and all compulsory cost will be split among all compulsory levels. Except, when specified by the USAG meet competitive site including both optional and compulsory gymnasts, then the cost will be divide among both optional and compulsory gymnasts. All payments are due in advanced by July 31st. Monies not rendered on time will be assessed a late fee determined by the executive board at such time. · All special competitions will be split up among all gymnasts both compulsory and optional for said meets as Future Stars, Hope, TOPS, USA Qualifier, Pan American, Visa Championship or any meet/clinic determined by the board and agreed by vote of the general membership. · Monies shall be transferred from your individual gymnasts’ accounts to Universal Gymnastics booster club to pay for expenses only at your request by written notification no less than one week in advance.
· Club’s Sponsorship donation are as follows: 1. Platinum is $5,000.00 and up 2. Gold is $1,000.00 - $4,999.00 3. Silver is $500.00 - $999.00 4. Bronze is $250.00 - $499.00 5. Supporting Sponsor is up to $249.00. · All businesses or companies donations will be divided as such 1. 10% operational cost of he booster club fees and charges 2. 10% special competitions (Future Stars, Hope, TOPS, USA Qualifiers, Pan American, Visa Championship) 3. 10% special need based scholarships and sponsorships 4. 60% to gymnast bringing in the donation 5. 10% to all other members of the booster club 5. All monies acquired by fund raising will be divided as follows; · The majority of the fundraised events will be done during the summer months of June to August. · When Compulsory is competing from August to December – Optional will be required to fundraise. · When Optional are competing from January to May – Compulsory will be required to fundraise. 1. 5% will be taken prior to general booster club operational cost 2. 10% will be taken prior to distribution for special competitions (Future Stars, Hope, TOPS, USA Qualifiers, Pan American, Visa Championship) 3. 85% will go into a general fundraising fund and will be distributed yearly prior to the start of competitive season in September equally to all gymnasts that have met the requirements with in the bylaws. · You can work 25 hours in any fundraising event per gymnast. · You can buy the hours at $10.00 per hour if your schedule does not permit you to work up to $250.00 per gymnast. · You can do a combination of the two above. 5. Any gymnast leaving the gym, his/her remaining money will stay in the general fund. 6. Annual Accounting Audit
Article VI
A. Executive Board The executive board will meet at least on a monthly basis. The exact date and time of the meetings are to be determined by the executive board. This meeting should be held prior to the date of any and all regular membership meeting. · The fiscal year will begin on July 1st of each year. The executive board shall meet before or on about July 1st of each year to plan the next year’s budget in which the board will present the budget to the general membership at a later date determined by the board.
B. General Membership The general membership should meet at least on a quarterly basis. The exact date and time of the meetings are to be determined by the executive board. Written notices to be posted in all common areas of the gym shall be given not less than 4 days nor more than 30 days prior to the date of the meeting.
C. Special Meetings Special meetings of the membership may be called when deemed necessary by the president, vice president or by petition/request of the general membership in writing to the board with specific reason.
D. Minutes Minutes of each meeting will be recorded by the club secretaries on an alternating basis. These minutes shall be distributed to the general membership and posted in common areas. It becomes the responsibility of the general membership to familiarize themselves with such said information on minutes.
Article VII
A. Term An election of officers shall be conducted every two years or as the position becomes available. The election process should be in the month of June with the term of office running from August to August.
B. Nominations Any and all vested parties can run for the executive board positions. Nominations may be made from the floor with the consent of the nominee. Each position voted on shall be decided by the majority vote. · The executive board may appoint a nominating committee consisting no less than three members to prepare, collect, count ballots, record, and report the results to the club president or vice president.
C. Vacancies · A vacancy in the office of president shall be filled by the vice president. · Vacancies in other offices shall be filled by appointments by the executive board or from its general members by vote.
D. Voting · For the transaction of Club’s business each family will cast one vote pending the member is in good standing and part of the booster club. · A quorum at any regular or special meeting of the members in good standing shall consist of a majority vote of two/thirds. For reason of changing bylaws a majority vote of two/thirds done by written ballots of the membership in good standing will be required.
E. Volunteering The majority of fund raisers will be done during the summer months from June to August. When compulsory are competing from August to December – Optional will be required to fundraise. When optional are competing from January to May – Compulsory will be required to fundraise. All monies collected will go into a general fundraising fund and will be distributed yearly prior to the start of the competitive season. There are three options in which to participate for the fund distribution. 1. You can work 25 hours in any fundraising event per gymnast 2. You can buy the hour at $10.00 per hour if your schedule does not permit you to work. $250.00 per gymnast. 3. You can do a combination of the two above.
Article VIII
A. Elected officers The elected officers consist of: president, vice president, secretary, and treasurer. The executive board shall have the authority to conduct the business and activities of the Club between meetings of the Club, subject to such limitations and guidelines of the bylaws. 1. Duties of Club Officers · President/Vice President preside at all meetings of the Club and establish the agenda for all club meetings with the approval of the board. Be the principal officers of the club and guide its functions. Be sure that all members are given notice of club meetings in accordance within the bylaws. Act in each others absence by his or her direction. Be sure that all legal matters are kept up to date not only as a 501c-3 but with all business within the club. Make any decisions in accordance within the bylaws and to the best interest of all gymnasts. · Secretary act as custodian of all records of the club, except for the accounts of the Treasurer and maintain a file for all such correspondence. Maintain and update as needed a current record of membership of the club. Establish each coming season’s total cost by such said deadlines of the bylaws to be given to the President or Vice President for final approval. Make arrangements when necessary for all coaches during each competition for travel to and from the events. In the absence of the President or Vice President, the Secretary may preside over any meeting and be empowered to make any decisions within guidelines. Perform other duties as the President and Vice President may direct with accordance of the Secretaries. · Treasurer act as custodian of all funds and keep proper records and accounts of all receipts and expenditures according to the procedures given by the board. Render financial statements on a quarterly basis to all members of the club on an individual basis. Also, provide semi annually the club operational cost to all club members. Treasurer shall confirm all monies given in the drop box, provide a receipt as necessary to the payee, deposit all monies on a weekly basis in the account of the booster club, and shall sign checks for expenditures. All checks must be signed by two of the following designated members of the board: President, Vice President, Secretary, and Treasurer. Be responsible for providing organized financial information for the preparation of the Booster Club’s tax return on a timely basis no later than May 1st of each year.
B. Appointed officers The president with the approval of the executive board shall select appointed officers. Such position may be temporary or concurrent with the terms of the executive board. 1. Fundraisers Coordinators will consist of no less than 3 members preferably from different levels or gender of the gymnasts. Each coordinator will be responsible for task assign by the President or Vice President in order to pursue the common goal of additional monies to the club. The coordinators will establish a plan on such set terms decided between the coordinators and board and be responsible for each event from beginning to end. Develop a plan to guide the members of the booster club in the effort to obtain donations and other financial support from organizations, companies, corporations willing to act as sponsors of the Universal Gymnastics Booster Club within the non-profit guidelines.
C. School Administrator The school administrator can be a voting member of the executive board.
D. Volunteers In order to be eligible to receive monies for any fundraiser all volunteers will be per family, only one volunteer will be honored during an event.
Article IX
A. No member of the club shall be personally liable for the debts, liabilities, or written procedures of the Booster Club.
Article X
A. Amendments The Universal Gymnastics Booster Club bylaws may be amended or revised by a two/thirds majority of the regular members present at a regular or special membership meeting.
